TERMS AND CONDITIONS OF THE

AG-AU DUBER COMPANY ONLINE STORE

 

§ 1

General provisions

(1) The online store operated by the company AG-AU Duber [hereinafter the "Store"] conducts retail sales via the Internet based on these Terms and Conditions [hereinafter the "Terms and Conditions"].

2. The Store is owned by AG-AU Duber Rafał Duber, ul. Kijewo 54, 63-000 Środa Wlkp., Tax ID: 786 165 30 90 , tel. + 690 352 534, e-mail address: duber@agauduber.pl .

3. The Terms and Conditions are an integral part of the sales contract concluded with the Customer.

4. The conclusion of a sales contract is conditional on the Customer's acceptance of these Terms and Conditions.

5. The prices given in the Store are gross prices (including 23% VAT).

6. The goods available in the Store are free from physical and legal defects.

 

§2

Orders

1. Orders can be placed as follows:

  • via a form available on the Store's website,

  • by e-mail to the address available on the Store's website,

  • by telephone at the numbers intended for placing orders, available on the Store's website under the Contact tab.

 

2. The fulfilment of a placed order is conditional on the Customer providing data which allows verification of the Customer and the recipient of the goods. The Store confirms acceptance of an order by e-mail or telephone. The Store has the right to refuse to accept an order, limit the payment method or demand prepayment if the order raises reasonable doubts as to the accuracy and reliability of the data provided or the payment method.

3. The parties are bound by the information available on the Store's website at the time of order placement, in particular: price, characteristics of the product, its features, components, delivery term and method.

4. The information on the Store's website does not constitute an offer within the meaning of the Civil Code. When placing an order, the Customer makes an offer to purchase the specified goods. The conclusion of the sales contract occurs when the Customer clicks the "Order and pay" button. At the same time, an order confirmation will be sent to the Customer's e-mail address specified on the order form.

 

§3

Payments

1. The customer has a choice of four payment methods:

- cash on delivery.

- transfer to a designated bank account.

- electronic transfer via Przelewy24, PayU.pl or PayPal.

- payment by credit card (the payment card operator is PayPro SA Agent Rozliczeniowy, ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register under KRS number 0000347935, Tax ID 7792369887, Regon 301345068).

- payment in cash upon collection at the company's premises.

2. Shipping prices are listed in the "Shipping" box on the left-hand side of the Store's home page.

3. The condition for the release of the goods is payment for the goods and shipment.

 

§4

Shipment of goods

1. Customers of the Store can choose from the following shipping methods:

- Pocztex48 courier

- InPost courier

- InPost parcel boxes

- Parcel collection points at Polish Post Service (Poczta Polska) branches

2. In the case of payment by means other than cash on delivery, the shipping date is extended by the period between order placement and the date on which the amount due is credited to the Store's bank account.

 

§5

Complaints

1. In the case of non-conformity of the goods with the contract, the Customer should send the claimed goods together with a description of the non-conformity back to the Store, at the Store's expense.

2. The Store shall respond to the customer's claim within 14 working days of returning the goods with a description of the non-conformity.

3. When a substantiated claim involves the delivery of a new item to the Customer or the removal of a non-compliance, the delivery costs will be borne by the Store.

4. If the claim is resolved in favour of the Customer, within 7 working days of the decision, the Store will compensate the Customer for the incurred costs by: repairing the claimed product, sending a new copy of the product or refunding the purchase price. In the case of pay card payments, the refund will be made to the card.

5. If the claim is found to be unsubstantiated, the Store will provide the Customer with a detailed justification of its decision and send back the claimed product at the Store's expense within 14 working days.

6. If the Store considers a complaint unsubstantiated, the Customer has the right to take the matter to an arbitration court or to a common court of law.

7. Individual settings of the Customer's computer and monitor which result in incorrect or distorted display of information about goods (e.g. colours) cannot be the basis for a complaint.

§6

Right of withdrawal from the contract

1. Pursuant to the 2 March 2000 Act on Protection of Certain Consumer Rights and Liability for Damage Caused by a Hazardous Product, the Customer has the right to withdraw from the contract.

2. The right of withdrawal shall be effective if the Customer submits to the Store, within 14 calendar days of receipt of the goods, a declaration of withdrawal.

3. The declaration can be made on a form, a model of which is annexed to the 30 May 2014 Consumer Rights Act or downloaded from the website of the Office of Competition and Consumer Protection at:

https://uokik.gov.pl/wzory_pism.php 

4. The Customer shall return the goods to the Store within 14 days of the declaration of withdrawal.

5. In the event of withdrawal from the contract, the cost of delivery of the returned goods shall be borne by the Customer.

6. Within 3 working days of receipt, the Store will inspect the condition of the returned product.

7. Within 7 days of inspecting the goods, the Store shall refund the amount paid to the Customer. The Customer should indicate the bank account number to which the refunded amount is to be transferred. In the case of pay card payments, the refund will be made to the card.

8. The Customer shall not have the right to withdraw in the cases set out in the Act referred to in subsection 1 above.

 

§7

Privacy protection

1. By placing an order, the customer agrees to the processing of their personal data solely for the purpose of fulfilling the order (issuing an invoice or receipt and dispatching the goods to the indicated address).

2. The Customer may also give separate consent to receive advertising and promotional material, including a trade newsletter, from the Store.

3. The customer shall have the right to access and amend their personal data, to request the cessation of its processing and to object to its processing in accordance with applicable law.

First and foremost is the EU regulation: Regulation no. 2016/679 of the European Parliament and of the Council (EU) of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (referred to as the "Regulation" for short), as well as national data protection laws.

 

 

§8

Intellectual Property

It is prohibited to use any materials published on the Store's website (including product photos and descriptions) without the Store's written consent.

 

§9

Entry into Force and Amendments to the Terms and Conditions

1. These Terms and Conditions shall come into force on the date of publication on the Store's website.

2. These Terms and Conditions may be amended.

3. Changes to the Terms and Conditions will be published on the Store's website.

4. Information on changes to the Terms and Conditions will be sent to the Customer at the e-mail address indicated in the order.

5. Any amendments to the Terms and Conditions shall enter into force following the lapse of 14 days from the date of publication thereof in the manner set forth in subsection 3.

6. The Store shall consider that the Customer has accepted the amendments to the Terms and Conditions if the Customer has not terminated the contract by the end of the period indicated in subsection 5.
